He is 70 years old, has lung cancer that has spread to his brain and is no longer able to work. He only gets social security and has been paying 400 towards rent. I pay for all the rest, all of the groceries and some of his medications.

Possibly if you provide more than 50% of his support. I would look it up online though.

I agree, they aren't married. He must get SS. If $1000 a month that's 12K a year. He gives u $400-$4800 a year leaving him $7200 left half would be $3600. Can you prove you put more out than that? This question needs to be asked to an acct or tax repairer.
